Digital Millennium Copyright Act Compliance Policy

1. Introduction and Commitment

ApkTrusted ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we have adopted this policy for responding to claims of copyright infringement.

We are committed to promptly processing and investigating notices of alleged infringement and taking appropriate actions under the DMCA and other applicable intellectual property laws.

This policy applies to all content accessible through our website and services (collectively, the "Service").

2. Notification of Claimed Infringement

If you are a copyright owner or an agent authorized to act on behalf of a copyright owner, and you believe that content available on our Service infringes your copyright, you may submit a written notification pursuant to the DMCA by providing our Designated Agent with the following information:

2.1 Required Elements of a Valid DMCA Notice

Your notification must include all of the following:

  • Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list
  • Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information reasonably sufficient to permit us to locate the material (e.g., direct URL links)
  • Contact Information: Your contact information, including your name, mailing address, telephone number, and email address
  • Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

2.2 Consequences of False Claims

WARNING: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. Please ensure that you are the copyright owner or authorized to act on the copyright owner's behalf before submitting a notice.

4. Processing of DMCA Notices

Upon receipt of a valid DMCA notification, we will:

  • Acknowledge Receipt: Send an acknowledgment of receipt within 24 hours
  • Review the Notice: Evaluate the notice for completeness and validity
  • Take Action: If the notice is valid, we will expeditiously remove or disable access to the allegedly infringing material
  • Notify the User: If applicable, notify the user who posted the content about the removal
  • Document the Action: Maintain records of all DMCA notices and actions taken

4.1 Response Timeline

  • Initial Response: Within 24 hours of receiving a complete notice
  • Content Removal: Within 24-48 hours for valid notices
  • Complex Cases: Up to 5 business days for cases requiring additional investigation

5. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent.

5.1 Required Elements of a Counter-Notification

Your counter-notification must include:

  • Physical or Electronic Signature: Your physical or electronic signature
  • Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
  • Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Contact Information: Your name, address, and telephone number
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which ApkTrusted may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person

5.2 Counter-Notification Process

Upon receipt of a valid counter-notification:

  • We will promptly provide the original complainant with a copy of the counter-notification
  • We will inform the complainant that we will replace the removed material or cease disabling access to it within 10 business days
  • We will replace the removed material or restore access within 10-14 business days after receiving the counter-notification, unless our Designated Agent receives notice that the original complainant has filed a court action seeking to restrain the alleged infringer

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, ApkTrusted has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6.1 Definition of Repeat Infringer

A "repeat infringer" is a user who has been the subject of more than two valid DMCA notifications within any twelve-month period, or who has had content removed more than twice for copyright infringement.

7. Modifications to Policy

ApkTrusted reserves the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after any changes indicates your acceptance of the modified policy.

8. Accommodation of Standard Technical Measures

ApkTrusted accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as defined in the DMCA.
